OFFICIAL SCHOLARSHIP RULES

Where as Dual Advisors is an Authorized Service Provider for the West Virginia Hope Scholarship;
Where as Hope Scholarship is mandated by W.Va. State Code §18-31-1 et seq. and operating under the administrative law rule W.Va. Code St. R. 112-18-1 et seq. It was created by the W.Va. State Legislature in 2021 and is administered by the West Virginia Hope Scholarship Board with staffing provided by the State Treasurer’s Office. Account processing and administration is contracted through a third-party vendor;
Whereas Dual Advisors is an education curriculum provider of college and high school accredited courses;
Whereas Dual Advisors offer these courses as Dual Enrollment eligible courses for students age 13 and above;
Whereas Dual Advisors assists students and parents with the Hope Scholarship application process;
Where as students or parents/guardians wish to take collegiate level courses for dual enrollment purposes and use the Hope Scholarship funds and/or other funding sources for this purpose.

1. ELIGIBILITY: The Hope Scholarship made easier by Dual Advisors is open to all who are thirteen (13) years of age or older at the time of application and /or who are currently enrolled (in a West Virginia public high school and will enroll no later than the fall of 2030) in an accredited post-secondary institution of higher learning (college, university or trade school). Current employees, officers, directors and agents of Sponsor and its related companies and members of their immediate families (defined as spouse, parents, siblings and children) and persons residing at the same address are not eligible to win. Void where prohibited.



2. HOW TO ENTER: To enter, beginning in the month of May 2024, submit a complete scholarship application online at the Sponsor’s Website (http://westvirginiahopescholarship.com) no later than June 17, 2024 at 11:59 pm Pacific Time. Limit one (1) application per person. Application must include name and contact information, background details and academic details. All applications become the property of the Sponsor and will not be returned. Sponsor assumes no responsibility for lost, late, misdirected, or unintelligible applications. By submitting an application, you fully and unconditionally accept and agree to these official rules and the decisions of the Sponsor, which are final and binding.



3. SELECTION OF POTENTIAL WINNERS: Sponsor is looking for eligible applicants who follow directions and submit applications that are well-written and clearly and creatively address the topic described above. Sponsor’s Ambassadors will contact ten (10) or more potential winner(s) from each weekly submission, based on the geographical location (100%).  The potential winner(s) will be notified by e-mail and or text/phone, at which time he/she will be required to sign further documentation and provide proof of residency as explained below. Sponsor shall have no liability for any potential winner notification that is lost, intercepted or not received by the potential winner for any reason. Sponsor reserves the right to choose no Scholarship Prize Recipient(s) if, in its sole discretion, it does not receive a sufficient number of eligible and qualified Applications and or the scholarship funding has been exhausted. Portions of the Prize-Winning Application may be posted on the Sponsor’s Website, or used in other marketing materials, without further compensation or notice to the winner.



4. PRIZES: Final winner(s) will receive a Scholarship award in the amount of four thousand nine hundred dollars ($4,921.00) each. The Scholarship Prize will be be distributed through the Treasurer’s office. The Treasurer’s Office has contracted with a third party to administer Hope Scholarship accounts electronically through the Education Market Assistant (EMA). Each family will have access to an EMA account for each eligible student in their household. All purchases will be made via an ACH transaction and will be pre-approved by the Treasurer’s Office. The annual Hope Scholarship amount will be split into two distributions, with the first half being placed into the student accounts by August 15 and the second half being placed into the student accounts by January 15. Scholarship Recipients can take from one (1) to five (5) general education courses at any given time. The Scholarship Recipient will be awarded collegiate credit upon successful completion of each course. Scholarship  may not be assigned, transferred, or changed, except at the sole discretion of Sponsor and in accordance to the rules and eligibility of the Hope Scholarship of West Virginia. No cash equivalent prize will be awarded. The awarding of any Scholarship is contingent upon full compliance with these Official Rules and subject to Sponsor’s verification of Applicant and Applicant’s submission. Applicants agree to be bound by Official Rules and agree that if any Scholarship Recipient fails to provide proof of identity, refuses to provide required affidavit, refuses to complete and provide any requested tax forms or residency requirements, is found to have violated the Official Rules or otherwise does not meet eligibility criteria. Applicants understand that Sponsor is not liable for injuries, losses or damages of any kind arising from participation in this Scholarship Program and acceptance, possession and use of Scholarship. Sponsor is not responsible for any typographical or other error in the printing of the offer, administration of the Scholarship Program or in the announcement of the Scholarship.



5. PRIVACY: By submitting an Application, you acknowledge that the Sponsor and its related companies may also call and/or send you information it thinks may be of interest to you, subject to Sponsor’s privacy policy at https://ScholarshipsforHomeSchoolers.org/privacy-policy



6. PUBLICITY: Except where prohibited, by accepting a Scholarship, the Scholarship Recipients agree that Sponsor may, without any limitation or further compensation or notice, use his or her name, voice and/or likeness in any and all media, worldwide, for the purpose of advertising and promoting the Website, the Sponsor, the Scholarship Program, or any other promotion, contest or sweepstakes sponsored by Hope Scholarship made easier by Dual Advisors West Virginia.



7. OWNERSHIP: In the case where an essay was required for submission the following applies: By submitting an application, you acknowledge and agree that: (a) Sponsor will own your application, and (b) as between you and Sponsor. Each applicant hereby irrevocably grants, transfers, sells, assigns and conveys to the Sponsor, its successors and assigns, all present and future right, title and interest of every kind and nature whatsoever, including, without limitation, all copyrights, and all rights incidental, subsidiary, ancillary or allied thereto (including, without limitation, all derivative rights) in and to the application and the written response submission(s) for exploitation throughout the universe, in perpetuity, by means of any and all media and devices whether now known or hereafter devised (the “Rights”). Sponsor shall have the right, in its sole discretion, to edit, composite, morph, scan, duplicate, or alter, the Application and written response submission(s) for any purpose which Sponsor deems necessary or desirable, and each Applicant irrevocably waives any and all so-called moral rights they may have in the Application and written response submission(s) submitted by him or her. Each Applicant hereby acknowledges that such Applicant does not reserve any rights in and to the Application and the written response submissions.



8. DISPUTE RESOLUTION:
 Except where prohibited, by participating, Applicant agrees that all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of participants and Sponsor and their agents shall be governed by and construed exclusively in accordance with the laws of the state of Minnesota  and the county of Hennepin, without giving effect to any principles of conflicts of law of any jurisdiction. Applicant agrees that any action at law or in equity arising out of or relating to this Scholarship Program, or awarding of the prizes, shall be filed only in the state or federal courts located in the state of Minnesota and Applicant hereby consents and submits to the personal jurisdiction of such courts for the purposes of litigating any such action. Except where prohibited, by participating in this Scholarship Program, Applicant agrees that: (a) any and all disputes, claims, and causes of action arising out of or connected with this Scholarship Program, or awarding of the Scholarship Prizes, shall be resolved individually, without resort to any form of class action; and (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with participating in this Scholarship Program but in no event attorneys’ fees; and (c) under no circumstances will any participant be permitted to obtain awards for and hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. Some jurisdictions do not allow the limitations or exclusion of liability for incidental or consequential damages, so the above may not apply to you.



9. REPRESENTATIONS AND WARRANTIES/INDEMNIFICATION. Each person who enters this Scholarship Program represents and warrants to Sponsor as follows: (i) the Application, including the written response submission (if applicable) is the Applicant’s own original, previously unpublished, and previously un-produced work; (ii) the written response submission is wholly original with Applicant and as of the date of submission, is not the subject of any actual or threatened litigation or claim; (iii) the written response submission neither infringes upon nor violates the intellectual property rights or other rights of any other person or entity; (iv) the written response submission does not and will not violate any applicable laws, and meets the Submission Requirements set forth above. Each Applicant hereby agrees to indemnify and hold the Sponsor harmless from and against any and all third-party claims, actions or proceedings of any kind and from any and all damages, liabilities, costs and expenses relating to or arising out of any breach or alleged breach of any of the warranties, representations or agreements of Applicant here under.



10. FURTHER DOCUMENTATION: Except where prohibited, potential Scholarship Recipients (or their parents or legal guardians if they are minors at the time of application) will be required to complete a Hope Scholarship Application with the Dual Advisors Ambassador which may include additional items, not limited to the following: an affidavit of eligibility, proof of residency,  public school attendance status, publicity/liability release, and other documentation as needed.

11. NO OBLIGATION TO USE. Sponsor shall have no obligation (express or implied) to use any winning Application, or to otherwise exploit a winning Application or continue the development, production, distribution or exploitation thereof, and Sponsor may at any time abandon the use of the winning Application for any reason, with or without legal justification or excuse, and the Scholarship Prize Recipients shall not be entitled to any damages or other relief by reason thereof.



12. IMPORTANT. PLEASE READ – GENERAL RELEASE AND LIMITATIONS ON LIABILITY. By entering the Scholarship Program, each Applicant acknowledges and agrees that the Sponsor, its related companies, affiliates, and each such company’s respective employees, officers, directors and agents are not responsible for any costs, injuries, losses, or damages of any kind arising from or in connection with: (i) incomplete, lost, late, misdirected or illegible entries or for failure to receive Applications due to any cause, including without limitation human, transmission, or technical problems, failures, or malfunctions of any kind, whether originating with sender, or otherwise, that may limit an Applicant’s ability to participate in the Scholarship Program; or (ii) any injury or damage resulting, directly or indirectly, in whole or in part, from participation in the Scholarship Program and/or the use of any prize, including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to, loss or destruction of property, or any claims, costs, injuries, losses, or damages related to or based on the Applicant’s rights of publicity or privacy, or the Applicant’s claim that he or she has somehow been defamed or portrayed in a false light. Sponsor assumes no responsibility for any damage to an Applicant’s computer system which is occasioned by accessing the Website or participating in the Scholarship Program, or for any computer system, phone line, hardware, software or program malfunctions, or other errors, failures, delayed computer transmissions or network connections that are human or technical in nature, or for the incorrect or inaccurate capture of information, or the failure to capture any information. This scholarship program is subject to all U. S. federal, state and local laws and regulations. Void where prohibited.



13. SPONSOR’S RIGHT TO MODIFY, SUSPEND OR TERMINATE. In the event Sponsor is prevented from continuing with the Scholarship Program by any event beyond its reasonable control, then Sponsor shall have the right in its sole discretion to modify, suspend, or terminate the Scholarship Program.



14. GENERAL PROVISIONS. Sponsor reserves the right in its sole discretion to disqualify any individual who is found to be tampering with the application process or the operation of the Scholarship Program or the Website, to be acting in violation of these Official Rules, to be submitting responses dishonestly or inaccurately, or to be acting in an unsportsmanlike or disruptive manner. In the event of a dispute as to the identity of any entrant, the authorized account holder of the email address used to enter will be deemed to be the entrant. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. If an Application is confirmed by Sponsor to have been erroneously deleted, lost or destroyed, the entrant’s sole remedy shall be another Application, if time permits. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that or of any other provision.



15. LIST OF SCHOLARSHIP PRIZE RECIPIENTS: The names of the Scholarship Prize Recipients of this Scholarship Program may be posted, at Sponsor’s sole discretion, on the WestVirginiaHopeScholarship.com website.

Applicability

We are entitled to identify you to third parties who claim that their rights have been infringed by your Submission. Submissions are not considered to be confidential. You agree not to make any Submission in which you have any expectation of privacy. We do not claim any ownership rights in Submissions; however, by making a Submission you hereby grant us an irrevocable, perpetual, non-exclusive, royalty free, worldwide license to use, telecast, copy, perform, display, edit, distribute and otherwise exploit the Submission, or any portion thereof, and any ideas, concepts, or know how contained therein, with or without attribution, and without the requirement of any permission from or payment to you or to any other person or entity, in any manner (including, without limitation, for commercial, publicity, trade, promotional, or advertising purposes) and in any and all media now known or hereafter devised, and to prepare derivative works of, or incorporate into other works, such Submission, and to grant and authorize sub-licenses of the foregoing without any payment of money or any other form of consideration to you or to any third party. Sweepstakes & Contests We may from time to time offer sweepstakes and/or contests. By entering a sweepstakes and/or contest, you agree to the Official Rules governing such sweepstakes and/or contest which are incorporated herein by reference. Disclaimers & Limitation of Liability YOU USE THE SITES/SERVICES AT YOUR OWN RISK. THE SITES/SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. To the extent we may not, as a matter of applicable law, disclaim any implied warranty or limit its liabilities, the scope and duration of such warranty and the extent of our liability will be the minimum permitted under such law.

Binding Arbitration Any controversy, claim or dispute arising out of or related to these Terms or the Sites/Services, including, but not limited to, alleged violations of state or federal statutory or common law rights or duties (a “Dispute”) will be solely and exclusively resolved according to the procedures set forth in this paragraph. If the parties are unable to resolve any Dispute through informal means, either party may initiate binding arbitration of such Dispute by sending notice demanding arbitration to the other party. The demand for arbitration will be made within a reasonable time after the Dispute has arisen, but in no event will it be made more than one year from when the aggrieved party knew or should have known of the controversy, claim, or facts forming the basis of the Dispute. The arbitration will be initiated and conducted according to American Arbitration Association rules and procedures for commercial arbitration, including, as applicable, provisions for the resolution of consumer disputes (the “Arbitration Rules”). The arbitration will be conducted in the county of Hennepin, Minnesota before a single neutral arbitrator appointed in accordance with the Arbitration Rules, or such other location as the parties may agree in writing. The decision of the arbitrator will be final without option to appeal. Disputes with an amount in controversy of $10,000 or less will be determined on the basis of written submissions only. SOCIAL NETWORKING SITE DISCLAIMERS As a condition of participating in the Scholarship Sweepstakes, you agree and acknowledge that Facebook Inc., Instagram, LLC, Twitter, Inc. and any other social networking sites used to promote the Scholarship Sweepstakes as well as their owners directors, officers, employees, contractors, agents, representatives, parents, subsidiaries, attorneys, insurers, and associated entities (collectively, the “Social Media Group”) are not sponsors of the Scholarship Sweepstakes nor do they endorse or administer the Scholarship Sweepstakes, nor are they in any way associated with the Scholarship Sweepstakes. All questions regarding the Scholarship Sweepstakes must be directed to Sponsor, not the Social Media Group. You also agree that as a condition of participating in the Scholarship Sweepstakes, you shall release the Social Media Group from any and all liability arising out of or relating to your entry, creation of an entry or submission of an entry, participation in the Scholarship Sweepstakes, acceptance, use, or misuse of any prize, or the broadcast, exploitation, or use of an entry.

ELIGIBILITY The Scholarship Sweepstakes is open only to: students who are permanent legal residents of the United States of America and residents of the State of West Virginia; (ii) are at least thirteen (13) years of age at the time of entry; (iii) are not barred from participation in the Scholarship Sweepstakes under the laws of the United States, including but not limited to all federal, state, and local laws; and (iv) at all times abide by these Official Rules. THE SCHOLARSHIP SWEEPSTAKES IS VOID WHERE PROHIBITED OR RESTRICTED BY LAW. ALL APPLICABLE FEDERAL, STATE AND LOCAL LAWS APPLY. Officers, directors, members, managers, employees, representatives, and agents of Sponsor and each of their respective parent companies, affiliates, subsidiaries, franchisees, prize providers, fulfillment agencies, including Immediate Family Members (as defined below) and Household Members (as defined below) for each of the aforementioned are not eligible to participate in or win the Scholarship Sweepstakes. “Immediate Family Members” shall mean spouse, parents, step-parents, legal guardians, children, step-children, siblings or step-siblings and each of their spouses regardless of where they reside. “Household Members” shall mean those people who share the same residence at least three (3) months a year.

3. SCHOLARSHIP SWEEPSTAKES PERIOD The Scholarship Sweepstakes begins on June 3, 2024 and ends on June 17, 2024 (“Scholarship Sweepstakes Period”). Potential winner(s) will be selected on or before June 17, 2024 + 90 days. Sponsor shall be the official timekeeper of the Scholarship Sweepstakes.

4. HOW TO ENTER NO PURCHASE OR PAYMENT OF ANY KIND IS REQUIRED TO ENTER. A PURCHASE OR PAYMENT WILL NOT INCREASE YOUR CHANCES OF WINNING. During the Scholarship Sweepstakes Period, eligible individuals may submit one (1) entry into the Scholarship Sweepstakes, as follows:
4.1 Fill in all the mandatory fields from the form athttps://westvirginiahopescholarship.com https://westvirginiahopescholarship.com/scholarship-app, or
4.2 Use ScholarshipOwl at https://www.scholarshipowl.com Upon completion of either of these steps, eligible individuals will be automatically entered into the Scholarship Sweepstakes. No additional action is necessary.

5. ENTRY CONDITIONS There is a limit of one (1) entry per person. Subsequent attempts made by the same individual to submit multiple entries by using multiple or false contact or account information, or otherwise, may result in the entrant being disqualified, at Sponsor’s sole discretion. Entries generated by a script, computer programs, macro-programmed, robotic or any other automated means are void and may be disqualified at Sponsor’s sole discretion. Entries that are in excess of the stated limits, incomplete, incorrect, illegible, corrupted, damaged, destroyed, forged, false, lost, late, misdirected, deceptive, or are otherwise not in compliance with the Official Rules are also void and may be disqualified from the Scholarship Sweepstakes at Sponsor’s sole discretion. Sponsor will not be responsible for invalid submissions and has no obligation to advise an individual of such a submission. If a problem occurs in the entry process, the entrant is solely responsible for verifying that the entry process has been validly completed. Entries received outside the Scholarship Sweepstakes Period will not be included in the Scholarship Sweepstakes. For purposes of this Scholarship Sweepstakes, an entry is “received” when the Sponsor’s servers record the entry information. Screen shots, printouts or other purported "proof" or "evidence" of entry or winning, in lieu of Sponsor's validation process, shall not be binding. Proof of sending (such as an automated receipt, screen shots, etc.) does not constitute proof of actual receipt of an entry for purposes of these Official Rules. All entries become the sole and exclusive property of Sponsor and will not be acknowledged or returned.

6. PRIZES AND PRIZE RESTRICTIONS Subject to verification of eligibility and compliance with these Official Rules, the following prize awards will be available to eligible entrants participating in the Scholarship Sweepstakes:
6.1 $4,921.00 Prize(s) will be awarded not to exceed five percent (5%) of the amount awarded per West Virginia pupil. WVSTO or Board to administer the ProgramThus, the Hope program enrolls 2.4% of eligible K-12 students and receives 0.6% of public funding for K-12 education. The total value of all prizes that could be awarded in the Scholarship Sweepstakes is approximately $6,000,000. Prizes will be awarded only if the potential prize winner fully complies with these Official Rules. All prize details are at the sole discretion of Sponsor and any depiction of the prizes, in Scholarship Sweepstakes materials or otherwise, is for illustrative purposes only. Prizes are non-transferable, non-exchangeable, and non-refundable, and must be accepted by the winner as awarded. A prize winner may waive his/her right to receive a prize. Sponsor shall have no responsibility or obligation to a prize winner or a potential prize winner who is unable or unavailable to, or who does not for any reason, accept or utilize a prize. In the event of non-compliance with these Official Rules, or if a prize is unclaimed, that prize will be forfeited. A forfeited prize may be awarded to an alternate winner, in Sponsor's sole discretion. All federal, state, provincial and local taxes, and all costs and expenses related to the acceptance and use of a prize not specified herein, are the sole responsibility of the prize winner. Any required tax reporting forms will be furnished to the appropriate authorities.

7. WINNER NOTIFICATION AND VERIFICATION Hope Scholarship made easier by Dual Advisors West Virginia potential winner(s) will be chosen at random from all eligible entrants that submit an entry as detailed above during the Scholarship Sweepstakes Period. Sponsor will attempt to notify a potential winner using the contact information provided on the potential winner’s entry within fifteen (15) days after the end of the Scholarship Sweepstakes. If a potential winner cannot be contacted or does not respond to Sponsor within seventy-two (72) hours of Sponsor’s initial notification, the potential winner may be disqualified at Sponsor’s sole discretion. A potential winner must provide Sponsor the information required to file any necessary tax reporting forms, including but not limited to their Social Security number or tax ID for tax reporting purposes if Sponsor is required to file an IRS Form 1099 with the Internal Revenue Service for the value of a prize awarded and accepted. Except where prohibited, a potential winner also may be required to sign and return to Sponsor, within five (3) business days from the date when Sponsor’s initial notification was sent, a declaration of eligibility and liability/publicity release (“Declaration”) via email to the address specified in the Declaration in order to claim his or her prize. If the Declaration is returned as undeliverable or incomplete or a potential winner fails to complete, sign and return the applicable Declaration within the required time period, or the potential winner does not adhere to the Official Rules, including without limitation, the potential winner does not fulfill the eligibility requirements, the potential winner may be disqualified at Sponsor’s sole discretion.  In the event a potential winner is disqualified for any reason, or if a prize is unclaimed or not accepted, the prize will be forfeited. If forfeited for any reason, the potential winner will not receive any other prize substitution or compensation, and the prize will remain the property of Sponsor and will not be awarded, except as provided herein. Sponsor, at its sole discretion, may award the forfeited prize to an alternate potential winner. If the Sponsor decides to select an alternate potential winner for the prize, the alternate will be selected according to the method used to select the potential winner. Sponsor will attempt to notify an alternative potential winner using the contact information provided on the potential winner’s entry. If a potential winner cannot be contacted or does not respond to Sponsor within seventy-two (72) hours of Sponsor’s initial notification, the alternative potential winner may be disqualified at Sponsor’s sole discretion. Sponsor retains the right to repeat this process until an alternate potential winner complies with the verification of eligibility requirements. ALL POTENTIAL WINNERS ARE SUBJECT TO VERIFICATION BY SPONSOR. SPONSOR’S DECISIONS AS TO THE ADMINISTRATION AND OPERATION OF THE SCHOLARSHIP SWEEPSTAKES, ANY CHANGES TO THESE OFFICIAL RULES, AND THE SELECTION OF POTENTIAL WINNERS IS FINAL AND BINDING IN ALL MATTERS RELATED TO THE SCHOLARSHIP SWEEPSTAKES.

RIGHTS OF PUBLICITY Except where prohibited by law, by participating in this Scholarship Sweepstakes or accepting a prize, you grant Sponsor and their designees to use and/or publish your full name, city and state of residence, photographs or other likenesses, pictures, portraits, video, voice, testimonials, biographical information (in whole or in part), and/or statements made by entrant regarding the Scholarship Sweepstakes, Sponsor, worldwide and in perpetuity for any and all purposes, including, but not limited to, advertising, trade and/or promotion on behalf of Sponsor in any and all forms of media, now known or hereafter devised, including, but not limited to, print, TV, radio, electronic, cable, or World Wide Web, without further limitation, restriction, compensation, notice, review, or approval. YOU FURTHER ACKNOWLEDGE THAT YOUR PERSONAL IDENTIFYING INFORMATION MAY BE DISCLOSED TO THIRD PARTIES INCLUDING, WITHOUT LIMITATION, PLACING YOUR NAME ON A WINNERS’ LIST.

10. GENERAL CONDITIONS Winning a prize is contingent upon accepting these Official Rules and fulfilling all requirements of these Official Rules. Sponsor reserves the right without liability to disqualify any entrant or cancel, suspend, modify and/or terminate the Scholarship Sweepstakes, or any part of it, for any reason, including, but not limited to, insufficient entries in the Scholarship Sweepstakes, any printing, seeding, typographical, technical errors, human or otherwise, suspected or actual evidence of electronic or non-electronic tampering with any portion of the Scholarship Sweepstakes, or if computer virus, bugs, unauthorized intervention, fraud, or technical difficulties or failures compromise or corrupt or affect the administration, integrity, security, fairness, or proper conduct of the Scholarship Sweepstakes or any other factor beyond Sponsor’s reasonable control, as determined by Sponsor at its sole discretion. In such event, Sponsor reserves the right to award the prizes to the extent required by law for eligible entries submitted up to the time of the impairment (and/or thereafter), or in such other manner as deemed fair and appropriate by Sponsor at its sole discretion. Sponsor also reserves the right to disqualify any individual it finds to be tampering or interfering with the operation of the Scholarship Sweepstakes, acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner and void such individual’s entry.  ANY ATTEMPT BY ANY PERSON TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THE SCHOLARSHIP SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK CIVIL AND/OR CRIMINAL PROSECUTION AND DAMAGES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. The invalidity or unenforceability of any provision of these Official Rules will not affect the validity or enforceability of any other provision. In the event that any provision of the Official Rules is determined to be invalid or otherwise unenforceable or illegal, the other provisions will remain in effect and will be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Sponsor's failure to enforce any term of these Official Rules will not constitute a waiver of that provision. Headings are solely for convenience of reference and will not be deemed to affect in any manner the meaning or intent of the Official Rules or any provision hereof.

11. EXTENDED MEANINGS; CURRENCY; FORCE MAJEURE Unless otherwise specified in these Official Rules, words importing the singular include the plural and vice versa and words importing gender include all genders. All dollar amounts referred to in these Official Rules are in lawful money of the United States of America. The Released Parties are not responsible for any damages caused by delay or failure to perform undertakings pursuant to these Official Rules when the delay or failure is due to weather, event cancellations, fires, strikes, floods, acts of God or the state’s enemies, lawful acts of public authorities, delays or defaults caused by common carriers, or other events that cannot reasonably be foreseen or provided against.

The Scholarship Sweepstakes Winners’ made easy by Dual Advisors list will be available upon request on or about June 17, 2024 + 90 days by sending a self-addressed stamped envelope to: Dual Advisors 5105 Oakview Ln N, Plymouth, MN 55441 , Attn: Winners’ List. The Winners’ List will be available for request at least three (3) months after the end of the Scholarship Sweepstakes. Listing of all particulars of minor children below the age of 18 will be redacted.
